Privacy Policy

This Privacy Policy explains how ATX Golf Performance ("Company," "we," "us," or "our") collects, uses, shares, and protects information when you use the Coach by ATX iPhone application, the coachbyatx.com website, and related services (collectively, the "Service"). By using the Service, you agree to this Privacy Policy.
1. Who We Are
The Service is operated by ATX Golf Performance, based in Austin, Texas. You can reach us at info@atxgolfperformance.com.
2. Information We Collect
Account information. When you create an account, we collect your name and email address.
Golf activity data. The rounds, holes, shots, clubs, distances, courses, scores, handicap, notes, and other information you record in the Service.
Payment information. Paid subscriptions are processed by Apple through the App Store. We do not receive or store your payment card information. We receive limited transaction data (such as subscription status) from Apple to provision your access.
Analytics and diagnostics. We collect product usage events, performance data, and crash reports (including device model, operating system version, app version, language, and non-precise diagnostic identifiers) to understand how the Service is used and to fix bugs.
Push notification tokens. If you enable push notifications, we store the push token issued by Apple so we can send coaching reminders and notifications.
3. How We Use Information
- Provide, operate, maintain, and improve the Service.
- Personalize coaching insights, benchmarks, and recommendations.
- Send you push notifications you've opted into.
- Process subscriptions and provide customer support.
- Detect, prevent, and respond to fraud, abuse, or security incidents.
- Comply with legal obligations and enforce our Terms.
4. Legal Bases (EEA/UK Users)
If you are in the European Economic Area or the United Kingdom, we rely on the following legal bases: performance of a contract (to provide the Service), our legitimate interests (to improve and secure the Service), consent (for optional features like push notifications), and compliance with legal obligations.
5. How We Share Information
We do not sell your personal information. We share it only:
- With Apple, in connection with account sign-in, App Store purchases, and push notifications.
- With service providers who process data on our behalf, including cloud hosting, analytics, and crash-reporting providers, bound by contractual confidentiality and security obligations.
- For legal reasons, when we reasonably believe disclosure is required by law, legal process, or to protect the rights, safety, or property of ATX Golf Performance, our users, or others.
- In a business transaction, such as a merger, acquisition, or asset sale, subject to confidentiality.
6. Data Retention
We retain your information for as long as your account is active and for a reasonable period afterward to comply with legal obligations, resolve disputes, and enforce our agreements. Backup copies may persist for a limited period after deletion.
7. Your Rights and Choices
Depending on where you live, you may have the right to access, correct, delete, port, or restrict the processing of your personal information, and to object to certain processing. To exercise these rights, email info@atxgolfperformance.com from the address associated with your account. We will respond within the time required by applicable law.
8. Account Deletion
You can request deletion of your account and associated personal information at any time from within the Coach by ATX app (Settings → Account → Delete Account) or by emailing info@atxgolfperformance.com. Once we verify your request, we will delete your personal information within a reasonable period, except where we are required or permitted by law to retain it (for example, transaction records or fraud prevention). Anonymized or aggregated data that cannot reasonably be linked to you may be retained.
9. Children's Privacy
The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided personal information to us, please contact info@atxgolfperformance.com and we will take steps to delete it.
10. California Privacy Rights (CCPA/CPRA)
California residents have the right to know what personal information we collect and how we use it, to request deletion or correction, to opt out of the "sale" or "sharing" of personal information (we do neither), and to be free from discrimination for exercising these rights. 11. Security
We use industry-standard technical and organizational safeguards, including encryption in transit, to protect your information. No system is perfectly secure, however, and we cannot guarantee the absolute security of your data.
12. International Data Transfers
We are based in the United States and process personal information in the United States. If you access the Service from outside the United States, you understand that your information will be transferred to, stored, and processed in the United States.
13. Push Notifications
If you enable push notifications, you can disable them at any time in your iOS device settings under Notifications → Coach by ATX.
14. Third-Party Links and Services
The Service may contain links to third-party websites or integrate with third-party services. We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies.
15. Changes to This Policy
We may update this Privacy Policy from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means and update the "Last updated" date above. Your continued use of the Service after the updated policy takes effect constitutes your acceptance of the changes.
